Fundamental Breach According to the Cisg

Article 25 A breach of contract committed by one of the parties is fundamental if it results in such detriment to the other party as substantially to deprive him of what he is entitled to expect under the contract, unless the party in breach did not foresee and a reasonable person of the same kind in the same circumstances would not have foreseen such a result. (CISG 1980) Used when: One of the parties suffers damages due to a breach of contract. The breach becomes fundamental when it is due to the other parties fault.This article could be interpreted as to whether or not the breaching party was ‘guilty’ of any form of neglect which caused the damages. If they could have prevented the damages, by handling reasonably, they are guilty of a fundamental breach of contract. Case: Tribunal: Court of Arbitration of the ICC Case#: 7531 of 1994 Seller’s Country: China (defendant) Buyer’s Country: Austria (claimant) Goods involved: Scaffold fittings Summary of the ca se: The plaintiff bought 80. 00 scaffold fittings from the Chinese seller. Upon delivery it turned out a substantial amount of the fittings were of bad quality. The buyer was only able to sell the goods partially and at a reduced price. Sorting out the good ones from the bad ones would have added an estimated third of the purchase-price. The Tribunal ruled in favour of the plaintiff as ‘an important part’ of the fittings did not conform to the sample which therefore resulted in a fundamental breach of contract.What was the effect of Article 25: It was proven that the plaintiff had suffered substantial damages due to the breach of contract. This enabled him to use art 25 and sue for damages. ? Article 35 (1) The seller must deliver goods which are of the quantity, quality and description required by the contract and which are contained or packaged in the manner required by the contract. 2) Except where the parties have agreed otherwise, the goods do not conform with the contract unless they: (a) are fit for the purposes for which goods of the same description would ordinarily be used; (b) are fit for any particular purpose expressly or impliedly made known to the seller at the time of the conclusion of the contract, except where the circumstances show that the buyer did not rely, or that it was unreasonable for him to rely, on the seller's skill and judgement; (c) possess the qualities of goods which the seller has held out to the buyer as a sample or model; (d) are contained or packaged in the manner usual for such goods or, where there is no such manner, in a manner adequate to preserve and protect the goods. 3) The seller is not liable under subparagraphs (a) to (d) of the preceding paragraph for any lack of conformity of the goods if at the time of the conclusion of the contract the buyer knew or could not have been unaware of such lack of conformity. (CISG 1980) Used when: This article is used when the goods delivered are not fit for the purpo se intended for them or when they are not of the same quality as the sample provided by the seller. They also need to be packed in a manner adequate to preserve and protect the goods. If they are not fit for purpose due to adequate packing, this the sellers fault. Note though that fitness for purpose is a broad term. For instance if meat has been purchased by a butcher in France he might deem the goods unfit as he meant to use them for Kosher meat. This does not count as the seller could not have foreseen this, unless it was mentioned.When selling it to a butcher in Israel however, the seller could have/ should have known these requirements. In fitness for purpose we look at the average quality required for products, unless expressly mentioned otherwise. Case: Tribunal: Bundesgerichthof (Federal Supreme Court) Case#: VIII ZR 159/94 Seller’s Country: Switzerland (Plaintiff) Buyer’s Country: Germany (Defendant) Goods involved: New Zealand Mussels Summary of the case: In this case the buyer bought mussels from a Swiss seller; the buyer later found they contained a cadmium level higher than the German health authorities allowed. Therefore he was not allowed to sell and he refused to pay due to a lack of conformity.The courts decided that though the cadmium levels in the mussels was higher than allowed in Germany, they were still eatable and did meet the standard required by the Swiss health authorities. It was therefore decided that the goods were of the required quality and the buyer should have mentioned the maximum cadmium levels allowed. What was the effect of Article 35: In this case it meant that the products did meet the required standard for quality of goods and the buyer had to pay for the products. ? Article 36 (1) The seller is liable in accordance with the contract and this Convention for any lack of conformity which exists at the time when the risk passes to the buyer, even though the lack of conformity becomes apparent only after that t ime. 2) The seller is also liable for any lack of conformity which occurs after the time indicated in the preceding paragraph and which is due to a breach of any of his obligations, including a breach of any guarantee that for a period of time the goods will remain fit for their ordinary purpose or for some particular purpose or will retain specified qualities or characteristics. (CISG 1980) Used when: The goods sold initially seem to be in good order, however after some time a lack of quality shows. This is only viable when the reason for this is due the sellers fault (e. g. When cars are sold and the paint starts to faint a month after the buyer obtained them, this could be the sellers fault due to using the wrong paint). Case:Tribunal: Bundesgerichtshof [Federal Supreme Court] Case#: VIII ZR 67/04 Seller’s Country: Belgium (Plaintiff) Buyer’s Country: Germany (Defendant) Goods involved: Frozen Pork Summary of the case: The buyer bought the goods to sell them on into Bosnia- Herzegovina. There were to be three deliveries of pork. In between deliveries a new ordinance was enacted in Germany (due to concerns regarding contamination of the meat) which stated that Belgian pork was no longer marketable unless a health certificated was provided. The defendants refuse to pay after they had been prohibited to resale the meats, which were then taken by customs and ultimately disposed of.The plaintiff argued that the risk had passed to the buyer when the goods were transported and therefor was liable for the events that took place. The court held however, that if the concerns were regarding to the harmfulness of the foodstuff to human health, the goods cannot be sold and therefor lack the required fitness for purpose. What was the effect of Article 36: Art 36 could be used in this case because the meat would already have been contaminated upon leaving the seller. Despite the fact that it was not detected until much later, when the risk had already passed to the buyer, the seller was still responsible as it was an initial breach of contract. ? Floods in India Essay

India, being a peninsular country and surrounded by the Arabian Sea, Indian Ocean and the Bay of Bengal, is quite prone to flood. As per the Geological Survey of India (GSI), the major flood prone areas of India cover almost 12.5% area of the country. Every year, flood, the most common disaster in India causes immense loss to the country’s property and lives. India Flood Prone Areas The states falling within the periphery of â€Å"India Flood Prone Areas† are West Bengal, Orissa, Andhra Pradesh, Kerala, Assam, Bihar, Gujrat, Uttar Pradesh, Haryana and Punjab. The intense monsoon rains from southwest causes rivers like Brahmaputra, Ganga, Yamuna etc. to swell their banks, which in turn floods the adjacent areas. Over the past few decades, central India has become familiar with precipitation events like torrential rains and flash floods. The major flood prone areas in India are the river banks and deltas of Ravi, Yamuna-Sahibi, Gandak, Sutlej, Ganga, Ghaggar, Kosi, Teesta, Brahmaputra, Mahanadi, Mahananda, Damodar, Godavari, Mayurakshi, Sabarmati and their tributaries. Though the north-Indian plains prone to flood more, the â€Å"India flood prone areas† can be broadly categorized in three divisions: Besides the Ganga, rivers like Sarada, Rapti, Gandak and Ghagra causes flood in eastern part of Uttar Pradesh. The Yamuna is famous for flooding Haryana and Delhi. Bihar experiences massive dangerous flood every year. River Burhi, Bagmati, Gandak, Kamla along with many small rivers contribute to that. In West Bengal, rivers like Mahananda, Bhagirathi, Damodar, Ajay etc. causes floods because of tidal effects and insufficient river channels. * Brahmaputra and Barak Basins: The river banks of Brahmaputra and Barak gets flooded due to the Surplus water found in the Brahmaputra basin and the Barak basin. These rivers along with their tributaries flood the northeastern states like West Bengal, Assam and Sikkim. Jaldakha, Teesta and Torsa in northern West Bengal and rivers in Manipur often overflow their banks. * Central India and Deccan Rivers Basin: In Orissa, spilling over of river banks by Mahanadi, Baitarni and Brahmani causes havoc. The deltaic area formed by these three rivers is thickly populated. Even some small rivers of Kerala and mud stream from the nearby hills add on to the destruction. Southern and central India observes floods caused by Narmada, Godavari, Tapi, Krishna and Mahanadi due to heavy rainfall. Cyclonic storms in the deltaic regions of Godavari, Mahanadi and Krishna even floods the coastal regions of Andhra Pradesh, Orissa and Tamil Nadu occasionally.

Factors that possibly affect first year performance in college - Essay Example For this study, the dependent variable was â€Å"First Year Performance† which was measured by taking the average of the grades received by the student from the courses he was taking. Independent variables were region of origin, age, and gender. Region of origin referred to the student’s place of study, and took the values of EU, OS, and UK. Age was divided into two values: regular (below 21 years old as of 1st September at the year of intake) and mature (below 21 years old as of 1st September at the year of intake). Gender took the values of Male and Female. In order to find if there were any regional effects on first year performance, Analysis of Variance was used. Analysis of variance tests for mean differences among a sample of three or more groups. To find if either age or gender had effects on first year performance, differences of the means of two groups were investigated using t test. Relationships between the variables which, incidentally, contained categorica l variables, were investigated using cross tabulation techniques and the chi square test. First year performance in college is a crucial measure because it says a lot regarding the initial progress of a student. In summary, age, gender, and region did not have significant effects on the overall first year performance of students. However, these factors did have certain effects on selected course units. Also according to the research findings regular students tended to come from OS more than from UK or EU.... Presentation and Discussion of Results Descriptive Statistics Table 1 shows a summary of the frequency and percentage distribution of a total of 238 respondents for this study. The figures show that 53. 8% were from OS (n = 128), 36.1% were from UK (n = 86), and 10.1% were from EU (n = 24). When grouped according to age, 87.4% were regular students (n = 208), while 12.6% were mature students (n = 30). When grouped according gender, 46.2% were male (n = 110) and 53.8% were female (n = 128). Figures from Table 2 indicate that the students had a mean average grade of 56.6 (SD = 12.2). Students had the highest mean grades in BMAN10001 (10) – Economic Principles: Microeconomics (Mean = 69.7, SD = 15.4) while lowest mean grades were in BMAN10621 (M) (10) – Fundamentals of Financial Reporting (Mean = 45.9, SD = 20). Effects of Age T test results showing effects of age on first year performance are summarized in Table 3. No significant effect of age was found in the average sco res of students, t(38) = .43, n. s. However, age was a significant factor in unit courses such as BMAN10801 (10) – Introduction to Work Psychology and BMAN10812 (10) – The Modern Corporation, t(36) = 2.06, p = .05, and t(191) = 3.27, p < .01, respectively. In both cases, Regular students scored higher (Mean = 56.4, SD = 11.9 and Mean = 57.4, SD = 12.1) than Mature students (Mean = 51.1, SD = 13.37 and Mean = 47.8, SD = 21.1). Production possibilities Essay The production possibility frontier PPF is a curve that shows all efficient combination of output in an economy when the factors of production have been used efficiently and optimally. (Lipsey et al 355). Assume an economy produces 2 goods (x and y) and technology is fixed and resources are fully utilized.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   To produce more units of x means that more resources will be transferred and less output of Y will be produced. The reverse is also true as production of more units of y reduces the production of X units. To produce more units of X may require that labor be increased. This reduces the labor for Y produced. Increasing the production of one good translates to increased ‘sacrifice’ or cost. The opportunity cost of producing X in terms of Y increases with the production of more ‘X’ commodity and consequently lesser units of Y are produced.   The opportunity cost increases as more of ‘X’ or ‘Y’ units are produced because although some resources may be suited for the production of both commodities some may not be efficient. For instance, diverting all laborers in X production to Y production may not yield effective results. There are two goods or commodities in the economy and it shows the trade offs between them. It assumes that common resources are used in the production of the two commodities. There is fixed technology. Technological changes could influence the production of one good over the other. There is full employment and fixed resources. These assumptions would be more applicable in the short run as opposed to the long run. (Lipsey et al 368). Production along the curve is termed as efficient. Therefore point d, c and e are efficient points of production operating within the economy’s capacity or at optimal. Production at point (a) is attainable but inefficient. Such combination is less than what the economy is capable of producing. Resources are not optimally utilized and hence the inefficiency. Production at point (b) is attainable given the economy’s capacity.   Ã‚  Ã‚  Ã‚  Ã‚   Land, labor, capital and entrepreneurship are the common or most recognized factors of production. Land entails natural resources that are at times modified and contribute to the production processes. Land varies in terms of its fertility. It is fixed but can be improved or renovated for instance swampy areas. (Lipsey et al 400).   Labor or human capital is also an important factor of production. Labor is the human resources or people who work. They include professional engineers or technicians capital includes ‘building machinery and tools. Labor is human be it effort be it mental or physical capital is man-made goods. People have varying skills and expertise resulting to varying wages and salaries. Labor can be improved through training. Capital is mostly used to refer to ‘financial ability’ but it includes the equipment or machinery that have to be put in place for successful production of goods. Entrepreneurship refers to the risk takers who operate businesses. They receive profits as laborers receive wages.   Ã‚  Ã‚  Ã‚  Ã‚   The PPF is a downward sloping curve due to the principle of increasing costs. (Lipsey et al 370). Increasing the production of X leads to a decline in the production of Y. It is concave to origin.   Ã‚  Ã‚  Ã‚  Ã‚   Production at point (b) can only be possible when the economy experiences growth, which could be due to various factors. Increased supply of resource for instance discovery of oil would increase the supply of natural resources as an increase in population due to migration would increase labor. Improvement in technology could lead to a more efficient and effective means of production that could shift the PPF outwards.   Ã‚  Ã‚  Ã‚  Ã‚   Point (b) lies outside the PPF and the economy needs to increase its efficiency, factor resources or improve on the technology. Similar goods have a downward sloping straight line PPF showing that the opportunity cost between them is constant.   Ã‚  Ã‚  Ã‚  Ã‚   Point (a) shows that some resources are unemployed and thus wasteful. An economy could be operating at this point if some of its resources are lying idle or if the resources are being used inefficiently in production.   Ã‚  Ã‚  Ã‚  Ã‚   Using previously used inefficiently resources efficiently as well as employing previously unemployed resources would also help an economy produce at ‘b’. State Of Nature Would Be State Of War Thomas Hobbes set out to account for political authority with the use of the State of Nature. He illustrated what life outside of society without any overall authority keeping anyone in check would be like. Hobbes identified the State of Nature with a State of War but used war in an extended sense, to include not just armed hostilities but any situation where there is no reasonable expectation that hostilities will not erupt. He argued that the known readiness to engage in acts of aggression amounts in itself to a State of War. Specifically there are three principal causes of quarrel (lev) which throw people into hostilities. These causes are competition, diffidence and glory (Lev p. 88) and together they ensure that the State of Nature is a State of War. The State of Nature put simply is a situation in which human beings have no government, no political institutions and the feelings that they engender and no executive forces such as a police force or army in other words, it is a condition of anarchy. The State of Nature is an idealisation, a model. (Engaging P.19) Hobbes uses the State of Nature to justify political authority, or as Hobbes calls it, the commonwealth. He does not describe literally everything that would be the case in the absence of political arrangements, but only those things that matter for explaining political authority. What Hobbes did, was to identify features of human nature and the human condition that are universal, that in no way depend upon political authority relations, and that are relevant to explaining political authority causally. The State of Nature can be considered as a condition from which people are to escape if political authority is to be justified. So the sole alternative to political authorit y is the State of Nature, however according to Hobbes, the State of Nature is unbearably nasty as what is crucial to the state of natures justificatory role is the fact that life in it is pretty grim. Therefore the sole alternative to political authority is unbearably nasty, hence imposing political authority is justified. Hobbes attempted to illustrate that subjection to authority is vastly preferable to anarchy the State of War; he held the view that if we had reasons to believe that political authority is much better than the State of Nature, then imposing political authority is justified. Hobbes attempted to demonstrate that the State of Nature is a State of War in order to justify political authority. He depicted the State of War as a place full of insecurity and uncertainty in order to further substantiate his claim. The State does not necessarily consist in actual fighting, but a known disposition thereto, during which there is no assurance to the contrary. (page 86 Leviathan). Hobbes depicted the State of War as a condition in which civilisation and its benefits are absent. Only through the organisation of society and the establishment of the commonwealth can civilisation be attained. One thing that Hobbes recognised about the natural condition of mankind was the relative equality of individuals within it. When Hobbes spoke of equality he did not mean equality in a moralised sense, but more the distribution of physical and mental endowments. Nature has made men so equal that, although some humans are manifestly stronger in body or of quicker mind, these endowments are distributed in such a way that even the weakest, slowest and dumbest among them can kill the strongest, fastest and smartest. Hobbes claimed that when all is reckoned together, the difference between man and man is not so considerable, all human beings are, in other words, vulnerable to assault at the hands of all others. Equality, for Hobbes, is based upon the equal ability to kill or conquer others so inevitably equality leads to conflict, a State of Nature will be a war of all against all.(leviathan p. Vii) In the State of Nature, there are three causes of conflict: competition, distrust and the desire for glory. Competition leads to fighting for grain, diffidence to fighting to keep what has been gained and glory to fighting for reputation. These sources of conflict arise from what Hobbes calls the equality of ability (lev) in men. This natural equality of men is not equality of rights or of worth but an equality of ability, which leads to equality of hope in attaining ones ends and so to competition. The right of each to all things invites serious conflict, especially if there is competition for resources, as goods -are in relatively short supply in the State of Nature.(Stamford) So if any two men want a single thing which cannot be attained by both, they will become enemies (page 84 Leviathan) Conflict can occur for example when someone has come to possess a better piece of land. If an invader would have nothing to fear but that one mans individual power, then it is more than likely that someone will choose to invade this estate and attempt to deprive the owner of his possessions. But then the successful invader will then be in similar danger from someone else. It is an endless cycle of conflict in the State of Nature, which inevitably creates hostile conditions. However, Hobbes claim that all men are equal is false. The very young, the very old and the infirm generally pose no mortal threat to able bodied persons in the prime of life and therefore there would be no competition in some circumstances. Whilst it was not Hobbess aim to describe what is literally the case, this does demonstrate that not all of his reasons were convincing when explaining why the State of Nature would be a State of War. Hobbes further illustrated a State of as a State of War as it is a place where nobody feels secure, each person has a reason to attack any other person, for fear of being attacked first; this is what Hobbes referred to as diffidence. Because of this distrust amongst men, the most reasonable way for anyone to make themselves safe is to strike first, so attack can be seen as the best form of defence in a State of War. And, because each person has roughly equal killing power, everybody is both a potential killer and a potential victim. The fact that each of them is liable to aggression from others means that each person has to treat every other person as an enemy. People dont just regard everyone as possible enemies, in the State of War everyone is an enemy. Hence diffidence makes people invade one another for safety. Hobbes quite rightly held that the State of Nature would be a State of War therefore as people would fear that others may invade them, and may rationally plan to strike fi rst as an anticipatory defense, a natural human instinct to preserve their own safety. Hobbes also said that The State of War arises from the nature of some people, mainly those who want others to value them as highly as they values themselves. Glory drives people to attack others to raise their value in the eyes of others. Glory is therefore a source of unwarranted aggression and when there is no common power to keep people at peace, conflict will occur which Hobbes quite rightly said. Hobbes had a particularly good reason for believing that the State of Nature would be one of war as morality has no place in this pre-political world that Hobbes created. Everyone has an interest in killing everyone else pre-emptively, whenever possible, and this is acceptable as nothing holds any individuals back from committing any immoral acts, humans would merely act as their interests dictate. In a State of Nature, by definition there are no rules, not even unenforceable ones that might deter some from committing such acts. Therefore even moral restrictions to do or withhold from doing certain things for example, not to kill have no effect in a State of Nature. Hobbess view was that in the natural State of War there are no objective moral distinctions. In this State of War of every man against every man nothing can be unjust. The notions of right and wrong, justice and injustice, have n place. Where there is no common power, there is no law, where no law, no injustice. Hobbes assumed that the state of nature would be a state of war as taking people as they actually are, if you were to remove all political institutions, the natural proclivities that would ensue would lead to a state of war. Notably, without political institutions, the natural impulses to self-preservation are doomed to failure. In the state of nature, that is our unhappy predicament. Natural right of self-preservation (ch. 14): the liberty each one has to use her/his own power for self-preservation. A central claim of Hobbes: It is rational to give up ones right to self-governance to a sovereign, if everyone else agrees to do the same. (See chapter 17, section 13) The natural state of war, therefore, is the state of affairs in which the individual is dependent for his security on his own strength and his own wits. In such conditions there is no place for hard work, because there is no assurance that it will yield results; and consequently no cultivation of the earth, no navigation or use of materials that can be imported by sea, no construction of large buildings, no machines for moving things that require much force, no knowledge of the face of the earth, no account of time, no practical skills, no literature or scholarship, no society; and-worst of all-continual fear and danger of violent death, and the life of man solitary, poor, nasty, brutish, and short. Perhaps we would imagine that people might fare best in such a state, where each decides for herself how to act, and is judge, jury and executioner in her own case whenever disputes arise-and that at any rate, this state is the appropriate baseline against which to judge the justifiability of political arrangements.

Integrating Technology into County High School Over the past few years' schools have been integrating technology into the classroom through new methods, ideas, grants, and personal experience. Not only has it enriched the learning experience as a whole but also it has proven to be effective in motivating and influencing students desires to learn not only in the classroom but outside as well. Through things such as state and federal funding it is possible to make some of these seemingly impossible technological advances come to a small town such as ours. Students from around the country who have already been awarded the privileges of being awarded technology grants said it helped them in five ways. These five ways were that the devices encouraged students to explore topics further, helped to manage time, provided new learning tools, made courses more interesting, and increased their learning. (Woke 1) with out expanding our educational technologies through out the district to include things such as iPads, laptops for every stude nt, and social networking to be used in the classroom will not be preparing its student body for the 21st century. With out a doubt County High School needs to move to more 21st century, hands on, and learning styles in the classroom. The question is what is the means of doing this and how do we integrate it into what we do now. It is a step by step process but one of the first things we need to do is make sure every kid has a laptop. This is extremely possible because Granville County School in North Carolina passed out 900 lap tops to ever student. (Granville 2) this is a great way to start putting technology into schools while making the parents and students aware. Also to insure quality and respons... ...he social networking cites and access you are able to make a broader spectrum of student to teach communication and student to student communication to discuss ideas. As far as bringing in your own devices it is a great idea because it saves the school money and we can still monitor your Internet access. Also for disciplinary purposes if you fail to meet the updated version of the AEP you will lose the privileges to take your laptop home with you and the time period will depend on the extent of the violation. The AEP will have to include things such as at home use and broken, stolen, or lost devices that were administered to the student. if County High School bands together to create a unified responsible student body that is willing to be educated and treat the technology seriously we have a very high success rate as to making 21st century learning work for us.

Exploring Rest Cure Therapy in The Yellow Wallpaper Rest was used as a cure for neurasthenia, but did it really work? "The Yellow Wallpaper" explores the concept of rest cure therapy and its effectiveness on a woman patient. The best-known doctor for treating neurasthenia was a highly regarded neurologist named Silas Weir Mitchell (Kivo 8). Women from all over the world traveled to the United States to be treated by Silas Weir Mitchell (5). Rest cure therapy included secluding the patient from family and friends and complete physical and intellectual rest (5). Many women who followed Mitchell's treatment plan returned to their families cured, but there were some women whose symptoms became worse after being treated by Mitchell or after being restricted to bed rest. Many women did not benefit from rest. In "The Yellow Wallpaper," Jane, the protagonist, is put on bed rest after giving birth to her baby. She is prescribed bed rest from her doctor and husband, John (6). John secludes her from family and friends by renting a rundown country home for the summer (6). She is to have total bed rest while at the country home. John said that Jane "was to have perfect rest" (Gilman, 14). As the summer progresses, Jane's condition becomes increasingly worse, and she begins to hallucinate. She thinks that she sees things moving on the yellow wallpaper in the room that she is staying in. Jane says, "The pattern does move-and no wonder! The woman behind shakes it!" (23). The therapy causes Jane to retreat into madness (Kivo 6). Jane's madness becomes apparent when the woman behind the wall and Jane start to tear all the yellow wallpaper from the walls of the room (25). Jane's condition deteriorate... ...herapy. Rest cures did not always work on all women. There were some patients like Jane who became worse while others like Addams and Gilman had to find their own ways of suppressing or curing their depression. Depression, or neurasthenia, was not always curable and has affected many people all over the world. Ernesto Che Guevara Essay -- Biography Ernesto Che Guevara Essays

Ernesto Che Guevara Ernesto "Che" Guevara has undeniably been one of the most powerful icons of the past fourty years. The Argentine revolutionary has had his picture widely printed on shirts and posters and has become a symbol for the (often young) anarchist. Yet, how many of us really understand or know what "Che" stood for? Do we know what his philosophy was about? Very few of us have taken the time to understand the goals and principles of Guevara and what he fought for - to death. Dr. Ernesto Rafael Guevara de la Serna (May 14, 1928 ? October 9, 1967), commonly known as Che Guevara, was an Argentine-born revolutionary and Cuban guerrilla leader. Guevara was a member of Fidel Castro's "26th of July Movement", which seized power in Cuba in 1959. After serving various important posts in the new government, Guevara left Cuba in 1966 with the hope of fomenting revolutions in other countries, first in the Democratic Republic of the Congo and later in Bolivia, where he was captured in a CIA-organized military operation. The CIA wanted to keep him alive for interrogation, but he was executed by the Bolivian army. After his death, Guevara became a hero of Third World socialist revolutionary movements, as a theorist and tactician of asymmetric warfare. It's in 1952, during a journey Ernesto made with his motorbike around South America, that he became harshly aware of the ravages of capitalism through the situation of the Native Americans. Influenced by the works of Jean-Paul Sartre, Pablo Neruda, Ciro Alegrà ­a and Karl Marx, Che Guevara devoted his life to fighting the "capitalist octopuses" to establish a socialist system that would be fairer to the people. As a young medical student Che set out on a motorcycle to travel around South America. The poverty and oppression and the impact of imperialism aroused his political awareness. In 1954 the Guatemalan government of Jacobo Arbenz attempted to nationalise the vast landholdings of the massive US multinational the United Fruit Company. The US government (which included two executive directors of United Fruit) organised an armed coup to overthrow Arbenz. Guevara who was in Guatemala at the time was appalled. He believed that well organised armed resistance could have defeated the coup and saved the Arbenz government. Escaping to Mexico he met a group of Cuban revolutionaries led by Fidel Castro, ... ...onary, humanist and extremely charismatic, Ernesto "Che" Guevara surely appeared as dangerous to many political leaders of the time, and still today, no one knows for sure who was behind his execution, in 1967. Two sides have particularly been designated as possible culprits: the CIA and Fidel Castro, who could have both felt threatened by the growing influence and determination of the revolutionary. Authentic to the extreme, Guevara dedicated his life, his existence to the cause he believed in, even if it implied sacrifices: "Our sacrifice is a conscious one; it is in payment for the freedom we are building." Today, "Che" has become a popular symbol while his image is too often dissociated from the philosophy that built it. Che Guevara remains, to many, a modern time hero, whose struggle and devotion made him one of the greatest revolutionary figures of all times. Maybe this incredible popularity is due to the humanist, sincere personality of a man who never stepped back, never sold out and fought passionately, to death ("Patria o muerte"). Another negative impact is that players are rewarded for their violent acts. The interactive quality of video games differs from passively viewing television or movies because it allows players to become active participants in the game’s script. Players benefit from engaging in acts of violence and are then able to move to the game’s next level. Gentile & Anderson (2003) state that playing video games may increase aggressive behavior because violent acts are continually repeated throughout the video game. This method of repetition has long been considered an effective teaching method in reinforcing learning patterns. Video games also encourage players to identify with and role play their favorite characters. This is referred to as a â€Å"first-person† video game (Anderson & Dill, 2000, p. 788) because players are able to make decisions affecting the actions of the character they are imitating. After a limited amount of time playing a violent video game, a player can â€Å"automatically prime aggressive thoughts† (Bushman & Anderson, 2002, p. 1680). The researchers concluded that players who had prior experience playing violent video games responded with an increased level of aggressionwhen they encountered confrontation (Bushman & Anderson, 2002). In a Joint Statement (2000) before the Congressional Public Health Summit, a number of American medical associations — the American Medical Association, American Academy of Pediatrics, American Psychological Association, American Academy of Family Physicians and American Academy of Child & Adolescent Psychiatry — caution parents about violence in the media and its negative effect on children. Their report states that exposure to violent media can elevate aggressive feelings and thoughts, especially in children. These effects on aggressive behavior can be long-term. Although fewer studies have been conducted on interactive video games, evidence suggests that playing violent video games may have a more dramatic influence on the behavior of children and adolescents (Joint Statement, 2000). Tips on managing your child’s media consumption Because of the popularity of video games, completely eliminating them from your child’s life might be difficult. But there are a number of suggestions for decreasing the negative impact that they might have on your child. Here are a few tips: * Know the rating of the video games your child plays (see below). * Do not install video game equipment in your child’s bedroom. * Set limits on how often and how long your child is allowed to play video games. * Monitor all of your child’s media consumption — video games, television, movies and Internet. * Supervise your child’s Internet use — there are now many â€Å"video games† available for playing online. * Take the time to discuss with your children the games they are playing or other media they are watching. Ask your children how they feel about what they observe in these video games, television programs or movies. The Entertainment Software Rating Board (ESRB) The Entertainment Software Rating Board (ESRB) is a self-regulatory body established in 1994 by the Interactive Digital Software Association (IDSA). The major video game manufacturers created this board after concerned groups and parents applied pressure over the content of video games. Similar to the movie industry’s rating system, all major game companies now submit their new products for rating to specially trained raters at the ESRB. The ESRB rates over 1,000 games per year. Early Childhood (EC): Content should be suitable for children 3 years and older and contain no objectional material. Everyone (E): Content suitable for persons ages 6 and older. The game may contain minimal violence and some â€Å"comic mischief.† Teen (T): Content suitable for persons ages 13 and older. Content is more violent than (E) rating and contains mild or strong language, and/or suggestive themes. Mature (M): Content suitable for persons ages 17 and older. Content definitely has more mature sexual themes, intense violence and stronger language. Adults Only (AO): Content suitable only for adults and may contain graphic sex and/or violence. Adult Only products are not intended for persons under the age of 18. Rating Pending (RP): Game has been submitted to the ESRB and is awaiting a final rating. The Columbus teen was rushed to the hospital with severe dehydration, where he recovered, according to a report from TV station WCMH on Aug. 7. Players who delve too deeply into their electronic worlds can face various health risks, ranging from deep vein thrombosis, or blood clots, to severe dehydration. For instance, in July, a Taiwanese teenager was found dead after sitting for 40 hours in an Internet cafe playing â€Å"Diablo 3.† At the time, doctors speculated he died from a heart attack caused by a blood clot that formed during the long session. And last summer, a 20-year-old man from the U.K. died from a blood clot after spending 12-hour sessions on his Xbox. His father told â€Å"The Sun† newspaper, â€Å"He lived for his Xbox. I never dreamed he was in any danger.† [10 Easy Paths to Self Destruction] While these are extreme cases, they are a reminder that sitting at a computer or console for days, whether it’s for â€Å"World of Warcraft† or for work, isn’t healthy for anyone. But psychologists who study video games and kids say parents needn’t worry about the amount of time spent gaming, unless screen time starts to affect school, health or social life. (And, of course, a stint of tens of hours gaming is likely to negatively affect schoolwork and lead to social woes.) That said, researchers remain concerned about the effects of violent content in video games, which have been linked by many studies to aggressive behavior. Too much screen time? These days, screens of one kind or another occupy youth for 50 hours a week, a 2010 survey by the Kaiser Family Foundation reports. â€Å"It’s a full-time job plus 10 hours of overtime, and that’s the average,† said Douglas Gentile, a psychologist and director of the Media Research Lab at Iowa State University. Video-gaming consumed nine weekly hours for teens, the Kaiser survey found, while a Harris Poll conducted for Gentile during the same period reported 13 hours a week spent gaming on computers and consoles. While some kids can shoot ’em up for hours, for others, too much time gaming leads to poor school performance. Recent studies have finally linked the cause and effect, showing that gaming displaces after-school academic activities such as homework and reading. A 2010 study from researchers at Denison University in Ohio, published in the journal Psychological Science, compared two groups of boys that had never owned gaming systems. They gave one group a system right away, but withheld games from the other group for four months. Boys who received the video-game system first had more teacher-reported learning problems and significantly lower reading and writing scores than the other boys. Problems in school are relatively easy for parents to fix: Limit screen time — of course, if you can get the controller out of his or her hands. The American Academy of Pediatrics recommends no more than one to two hours per day in front of any electronics. Violent games and aggression What’s harder to control is violent content in video games. The Pew Research Center reported in 2008 that more than 90 percent of games rated as appropriate for children 10 years or older contained violence, including games rated â€Å"E† for everyone. (Most researchers define violence as the ability of a player to intentionally harm others in a game.) Now most researchers will agree that video games can help as well as harm. For example, educational games boost learning, and action games can improve vision and spatial skills. Video games have also been used successfully to teach children self-care skills for asthma and diabetes. And then there’s the primary reason people play video games: They’re relaxing. Gentile thinks the flickering screen and varying sound levels trigger a primitive brain response. â€Å"One of the reasons I think we find television and video games so relaxing is they provide the attention for you. It forces you to orient to the media. You don’t have to work to pay attention like you do in [a] classroom lecture,† said Gentile. But a preponderance of evidence links violent video games to an increase in aggressive behavior in teens. The behavior wasn’t violent crime, like school shootings, but small yet hurtful offenses like teasing, name-calling, rumor-spreading and fist fights. In a review of 130 studies of kids and teens, Iowa State University researchers found that violent video games increased the likelihood of aggression and decreased empathy. Of course, repeated exposure to violence in any environment has a deleterious effect, Gentile noted. â€Å"Seeing violence anywhere increases the risks that a child might become involved in aggression, whether as a perpetrator or a victim,† he said. But video games are phenomenal teachers. Players get immediate feedback and rewards for punishing competitors. And not only do games reward hostility, they train your brain to respond to real-life problems with aggression, research indicates. In fact, games can prime teens to react to slights with name-calling or pushing, instead of choosing to avoid confrontation. â€Å"So when I get bumped in the hallway, I don’t assume it’s an accident anymore,† explained Gentile. â€Å"What comes to mind first is to retaliate in some way. Those aren’t the only options you have, but we never think of them because what we see over and over in the media is ‘You killed my monster, now you must die.'† But psychologist Patrick Markey’s research suggests just some teens are susceptible to these effects. Markey found people withcertain personality traits — those who are highly neurotic, less agreeable and less conscientious — are those more likely to become hostile from gaming. The 2010 study appeared in the journal Review of General Psychology. â€Å"The truth of the matter is that most people can handle this media, but for some people with a select predisposition, these people might be a little more aggressive, more prone to an argument here and there,† said Markey, a professor at Villanova University in Pennsylvania. â€Å"The most interesting part is there is really no research that suggests video games have a different effect than TV or movies. It has empirically never been shown,† said Markey. â€Å"Any media is supposed to engage us emotionally, and video games are a form of media, a form of art even.† Recreational Gaming If all this hoopla surrounding a seemingly innocent pastime has you baffled, count me in. For people who view it as a source of entertainment, or even as a recreational activity, gaming spells out pure pleasure. Some may even wish to classify it as a brain workout. They can be very alluring and once you get involved they can be very absorptive. Many of them are fun and very realistic. They should be treated like any activity and done in moderation. They can be huge time wasters so anyone playing them should be aware of that. As a counselor I wouldn’t discourage playing games. I would ask the person how involved they are how they interact with them. If they spend too much time, I would advise they look at that behavior. If I had a student who what adicted to playing games, I would treat it like all adictions. People can get hooked into these games because they provide a challenge; they are very realistic; and they are an opportunity to â€Å"pour† yourself into something. The positives are that they are an excellent change of behavior if you need that. The negative are that someone can let them get out of control and control their life. They can spend too much time playing. They can loose sleep. They can get addicted. I do not believe there is any long-term affects to playing the game itself. They are very real but they are not reality. If someone confuses them with reality, they have a worse problem then playing the game and that should be addressed. Case For Several research studies have been conducted that indicate video game addiction is real in around 10% of gamers who meet criteria for video game addiction. Grà ¼sser et al (2007) found that pathological gamers differed from regular gamers in terms of daily time spent playing, and had higher â€Å"expected relief of withdrawal symptoms when gaming,† and higher â€Å"craving due to the expectation of a positive outcome of gaming.† These are all characteristics which mirror those of of substance dependence. Skoric et al (2009) showed that video game addiction is independent of simply how much time is spent playing, and how engaged children are with the game. In their study, addiction tendencies were negatively related to scholastic performance, while no such relationship was found for either time spent playing games or for video game engagement. A similar pattern of video game addiction being negatively related to scholastic performance was previously found in a separate study by Chiu et al (2004). Charlton’s (2002) factor analysis provided support for computer addiction as a unique concept. This research demonstrated the importance of recognizing the specific characteristics of computer addiction, rather than simply adapting measures of pathological gambling, which are likely to overestimate the occurrence of computer addiction. Recognition of video game addiction would allow support services to be integrated into community addiction settings, and specific training to be provided to staff. This is particularly important given the high incidence of concurrent disorders among those with video game addiction. Case Against Video game playing may have several advantages. Proficiency in video games can develop the self esteem of the player. It can develop eye-hand coordination, and can have other educational features. More sophisticated games can help players to develop other skills, and recent developments have built in aspects of physical exercise — although this may have limited appeal to gamers. The reality of popular culture is that we are more and more dependent on technology. A generation ago, computers were complicated and difficult to use, but modern computers are more user-friendly, and are relatively easy and enjoyable for the majority of people to use. Video games allow people to have positive experiences of using computers, that can provide transferable skills for using computers for a variety of purposes. Bearing in mind the potential positive effects of video game playing, to label the activity an addiction without sufficient evidence and interpretive guidelines about what constitutes addiction (as opposed to benign or positive game playing) could deter many children and their parents who could possibly benefit from video games. This would be a mistake. There is wide variation in video games, and although some appear to have harmful effects, particularly through the promotion of violence and other anti-social behaviors, this is a function of the content of specific games, rather than a characteristic of video games per se. Video games as a medium have equal potential to develop positive social skills, or to provide benign forms of entertainment — although these may not be as easily marketable to kids. As with other addictions, there is a risk that a label like video game addiction could be used too liberally, without paying attention to other concurrent or underlying conditions, such as attentional problems, autism spectrum disorders, depression and anxiety disorders. These conditions have different treatments which might more effectively help the excessive game player. And video game addiction is vulnerable to the same criticism that all behavioral addictions are — that addictions are a chemical problem resulting from the intake of addictive substances, not a pattern of behavior. Where It Stands The APA is not saying that video game addiction does not exist, nor that it is not addiction, but simply that they are looking at the issue and won’t make a decision until the next edition of the DSM comes out in 2013. In the same release in which they withdrew their recommendation that video game addiction be recognized, the APA expressed serious concern about the consequences of excessive video game playing in children, stating: â€Å"Psychiatrists are concerned about the wellbeing of children who spend so much time with video games that they fail to develop friendships, get appropriate outdoor exercise or suffer in their schoolwork. Certainly a child who spends an excessive amount of time playing video games may be exposed to violence and may be at higher risks for behavioral and other health problems.† Therefore, whether or not video game addiction is acknowledged as a real addiction, or even as a mental health problem in and of itself, the APA is clear that excessive video game playing in children can be unhealthy, and can lead to other problems.
